( 1) That this House aware of the fact that 🙁 a) on 14 November 2019, a gesture for an order for papers was approved in the Legislative Councilrequiring the production of, among other documents, all asbestos registries held by SydneyTrains, NSW Trains, State Transit, Sydney Metro and RailCorp, all legislativecompliance cross-files held by Sydney Trains, NSW Trains, State Transit, Sydney Metro and RailCorp and the health checking records for exposureto asbestos for Sydney Trains hires,( b) the above-mentioned documents returned to the Clerk ofthe Parliaments on 5 December 2019 did not includeany of these cross-files, and( c) in communication dated 5 December 2019 and addressed to Matt Richards, Acting Executive Director, Legal, the DepartmentPremier and Cabinet, Mr Rod Staples, the Secretary of Transport, stated: As notedin previous responses to Order for Papers directedto the Department, citations in an ordering to the Department of Transport will be understoodas meaning a reference to the Department of Transport only.( 2) That this House notes that 🙁 a) insufficient responses to requires for newspapers, as with inadequate answers to questions, isa growing concern which is undermining the abilityof this House to hold the Government to account, especially in relation to the TransportCluster, and( b) the 2019 changes to the machinery of governmentand a lack of clarity regarding the responsibilities within the Transport Clusterhas forestalled efforts to obtain information anddocuments necessary to examine activities and decisions of this Government .( 3) That, under Standing Order 52, there belaid upon the table of the House within six daytimes of thepassing of this resolution the following documents in the property, incarceration or command of Transportfor NSW, Sydney Trains, NSW Trains Link, State Transit, Sydney Ferries, RailCorp, and SydneyMetro:( a) all asbestos registries held by Transportfor NSW, Sydney Trains, NSW Trains Link, State Transit, Sydney Ferrying, RailCorp, and SydneyMetro,( b) all legislative conformity registries heldby Transport for NSW, Sydney Trains, NSW Trains Link, State Transit, Sydney Ferry, RailCorp, and Sydney Metro,( c) the health checking records for exposureto asbestos for Sydney Trains works,( d) the state observing records from 1 January2 012 for all NSW, Sydney Trains, NSW Trains Link, State Transit, Sydney Ferry, RailCorp, and Sydney Metro works to be subject to asbestos ,( e) all match, reports and briefings, generated since 1 January 2018, relating toany asbestos register or legislative complianceregister within NSW, Sydney Trains, NSW Trains Link, State Transit, Sydney Ferrying, RailCorp, and Sydney Metro, and( f) any legal or other opinion regarding thescope or cogency of this order of the House createdas a result of this require of the House .( 4) That certificates returned to this orderbe redacted to remove any identifying personal state items.( 5) That, should the Leader of the Governmentfail to table the documents in compliance with thisresolution, it will be matter for this House to make necessary actions and further stepsto address the issue of continued non-compliance ..
